This User Agreement ("Agreement") is entered into between you ("User") and the creators of The Bro Coaster Mobile Application, and the Bro Coaster Device, Legends Bros LLC ("Company" or "we" or "us"), collectively referred to as "Parties."
By downloading, installing, accessing, or using Bro Coaster App ("App"), you agree to be bound by the terms and conditions set forth in this Agreement. If you do not agree to these terms and conditions, please refrain from using the App.
1. User Eligibility: 1.1. By using the App, you represent and warrant that you are at least the legal age for consuming alcoholic beverages in your jurisdiction. If you are not of legal drinking age, you must immediately uninstall the App and discontinue its use.
2. Game Rules: 2.1. The App offers a drinking game experience, and you understand and acknowledge that alcohol consumption can have risks. You agree to drink responsibly and in moderation while participating in the game. We strongly advise you not to drink and drive or engage in any hazardous activities that may endanger yourself or others.
3. Assumption of Risk: 3.1. You understand and accept the risks associated with using the App, including but not limited to the potential for excessive drinking, loss of control, and impairment of judgment. You voluntarily assume all such risks and agree that the Company shall not be liable for any damages, injuries, or consequences arising from your use of the App.
4. User Conduct: 4.1. You agree to use the App in compliance with all applicable laws, regulations, and this Agreement. You will not use the App for any unlawful or prohibited purposes. 4.2. You agree not to misuse, modify, reverse engineer, decompile, or attempt to extract the source code of the App, or interfere with its functionality in any way.
5. Intellectual Property: 5.1. The App, including but not limited to its content, trademarks, logos, graphics, and software, is the intellectual property of the Company. You acknowledge and agree that all intellectual property rights in the App are owned by the Company or its licensors. 5.2. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App solely for personal, non-commercial purposes.
6. Indemnification: 6.1. You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to your use of the App or any violation of this Agreement.
7. Limitation of Liability: 7.1. To the maximum extent permitted by applicable law, the Company shall not be liable for any direct, indirect, incidental, consequential, or exemplary damages arising out of or in connection with your use of the App, even if the Company has been advised of the possibility of such damages.
8. Termination: 8.1. The Company reserves the right to suspend or terminate your access to the App, in whole or in part, at any time and without prior notice, if it reasonably believes you have violated this Agreement or engaged in any unauthorized use of the App.
9. Modifications: 9.1. The Company reserves the right to modify or update this Agreement at any time. Such modifications will be effective upon posting on the App or providing notice to you. Your continued use of the App after any modifications constitutes your acceptance of the modified Agreement.
10. Governing Law and Jurisdiction: 10.1. This Agreement shall be governed by and construed in accordance with the laws of [Jurisdiction]. Any dispute arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts of [Jurisdiction].
11. Deleting User / Data: 11.1. To delete your user account / data please use the Bro Coaster App on Apple App Store or Google Play or contact customer support.
12. Entire Agreement: 12.1. This Agreement constitutes the entire agreement between the Parties regarding the use of the App and supersedes all prior or contemporaneous agreements, understandings, or representations, whether written or oral.
By using the App, you acknowledge that you have read, understood, and agreed to be bound by this User Agreement.
